Social Security Attorneys Fees for the Long Term Disability Claimant

So many clients report to me that they used a particular Social Security representative because their Long Term Disability insurance company recommended the representative.  It has been told to me any number of times that the disability insurance company representative will tell them the insurance company will pay the attorney’s fees if the long term disability claimant will use a particular representative.

This is a half-truth which turns into a big lie when the long term disability claimant ends up with an incompetent non-attorney representative who is part of a nationwide claims mill.  Cases get dropped and, even when they are successful, your attorney seems to become the agents of the long term disability insurance company by wrongly speaking liberally about the cases with them without regard to the attorney-client relationship which should act to protect you from such behavior.  Unfortunately, it does not because these factories know who is paying them.
The fact is that the attorney’s fees you incur in the course of securing Social Security benefits are automatically deducted from anything you may owe back to the insurance company as a result of receiving past Social Security benefits.  So, one way or the other, you are not paying the attorneys out of your pocket.  Yet, the claim is yours, the need for the income stream is important and the attorney’s obligations must be to you.  You must choose your own Social Security attorney.
Keep in mind, I am not trying to drum up business.  I do not handle Social Security claims as I focus entirely on the short term disability and long term disability benefits you get from private or governmental employers.  I just want you to get the best possible representation and I want these insurance companies to start telling the whole truth.  I am truly jousting at windmills now.
