Back conditions are one of the kinds of conditions that we see in our law practice with the most frequency. We’re sharing what this kind of condition can mean for LTD claims. 

Often times, the exact nature of a back condition can be misconstrued by insurance companies working to find a reason to deny your claim.  This is usually in spite of the fact that a physician has diagnosed you with a particular back condition, or in fact, performed surgery on you and saw your disabling condition with their own eyes. Conditions like degenerative disc disease, radiculopathy, sciatica, nerve impingement and other issues related to the L5-S1 levels are commonly seen in our practice.

 Language in Short- and Long-Term Disability policies will seek to limit entitlement to benefits by excluding conditions that have been diagnosed solely through subjective complaints. However, for the majority of back conditions, like herniated discs, nerve impingement, degenerative disc disease, and sciatica, the conditions can be shown through objective testing.

 Most cases of back pain are caused by stresses on the muscles and ligaments that support the spine. Sedentary jobs and lifestyles contribute to this kind of stress and/or damage. Insurance companies will be looking for a specific cause for the back pain, and at times, the exact nature of back pain can be difficult to ascertain through standard objective testing.
