 Turning to claims for Long Term Disability benefits for Harris Corporation employees, those claims are governed by a federal statute Long Term Disability at Harris Corporation commonly referred to as “ERISA,” or, the “Employee Retirement Income Security Act.”  As of the last time the author had occasion to review the Harris Corporation Long Term Disability benefits plan, Harris Corporation, unlike most employers, had not purchased an insurance policy to pay these benefits.  Instead, the contributions made toward long term disability benefits are held in a trust fund which is governed by a committee cloaked with the authority to make benefit determinations.  Those committee members are Harris employees.  It would be hoped that this make them more amenable to the claims of fellow employees, in full consciousness of the obligations of a fiduciary which is the legal capacity they are in with respect to the beneficiaries of trust- employees of Harris Corporation.  This may or may not be the case; it is the experience of the writer that when a determination is made, it seems well nigh impossible to move them off of the predetermined mind set, even more so at times than when dealing with insurance companies.
