From my many years of experience in the Short Term Disability and Long Term Disability area of the law, it has become apparent to me that the medical and vocational issues are not the only factors driving the insurance company’s benefits determination in a Short Term Disability or Long Term Disability benefits claim.  Of course, medical and vocational issues should be the only considerations, but they are not.

 What Makes Insurance Companies Pay Long Term Disability Benefits?

 One of those factors is quite bothersome.  All too often I see age play a role.  This can cut both ways.  For young claimants, insurance companies do not want to pay benefits and administer files for long periods of time.  In these types of cases, the insurance companies look around early and often for ways to get out of underpaying these claims.  While they will parse the medical records however they can, they will also use any procedural trick to get out of having to pay.  Claims brought on behalf of younger claimants (i.e., under age 55) must be presented in as pristine a manner right from the get-go.  We have successfully walked innumerable clients through the application process for both Short Term Disability and Long Term Disability benefits claims.

 On the other hand, it has become common practice for insurance companies to try and cheat older claimants out of the last couple of years of benefits.  It seems that most attorneys who represent claimants are looking for easy cases, with low-hanging fruit in the form of large dollar amounts of benefits at issue.  I believe the insurance companies are trading on the fact that most attorneys handling these cases simply do not care to bother with the smaller claims.  While the undersigned has routinely represented claimants with millions of dollars of benefits at issue, it is my experience that the claimant with the smaller claim has just as great a need.  This is why we have an “all comers” approach, designing our attorney’s fees in a mutually beneficial manner so as to allow this.
