In terms of legal representation in connection with your Short Term Disability or Long Term Disability benefits claim, Herbert M. Hill, P.A. is a “full service” law firm.

This means we represent clients from beginning to end on these claims.  Other firms who handle these claims only represent clients once benefits have been denied.  Not so with us!  We get involved as early as possible to prevent a denial from ever occurring.

Benefit Application: Your First Step in the Claims Process

One of the key steps in that process is the properly presented benefit application. That subject has been previously discussed.  The next step sometimes is a conference or interview with a field representative on behalf of the insurance company.  There are a few important points to be considered at this point.  First, the field representative is not the person primarily responsible for your claim.  So, the field representative can usually not provide any specifics about your case although he or she will be seeking some very specific information from you.  This does not mean you should not cooperate; it just means you need to keep your eyes wide open and not expect much in return.

Step Two: Conferences with Field RepresentativesConferences with Field Representatives

The second point is the location of the interview.  They want to get inside your house if they can.  They will be trying to secure all information available about you and not just from your answers but what they see in your surroundings.  You might try to tidy up before they come and they will suggest that is inconsistent with your statement that you cannot now do your housework as you once were able.  This is just one example of a number of leaps of logic that I have seen these field representatives make.  We can guess they are just trying to advance their careers by sounding helpful to their employers but it does you no good.

Please keep in mind that in the course of your representation our every effort will be focused on achieving what we call the “highest and best” result for you- getting you on regular disability checks and keeping you there.  Cooperation with the insurance company is important as long as it is within reasonable bounds.  What that means varies from case to case but you should not leave yourself wondering.  If you have any questions about your Short Term Disability or Long Term Disability claim, give us a call and we can guide you through the process.  Our goal will be to secure you the benefits to which you are entitled.  We will do this in a way that causes you the least amount of stress so you can focus on your medical treatment and keep yourself at the highest level of function possible.
