The day you hire our firm, we will send out letters to your Employer and the Insurance company. These institutions have 30 days to produce these documents. During that time, we open your file and calendar the appeal to ensure its timely filing as well as collect and summarize your medical records.
Gather Documents
As your Winter Garden Long Term Disability attorney, we will schedule a conference for 35 days down the road for us to assess where we are and what else we need to do to get the appeal in its final form. Hopefully, by that time, we have received all necessary documentation. The documents from the insurance company, known as the “Administrative Record,” are forwarded to you upon receipt. You can then provide input on the information in that file, especially with respect to any inaccuracies you may note. We will also discuss at that conference whether additional information is needed from the treating doctors.
Timetable for Appeals
Our clients should expect that it takes three to four months to get an appeal out. We will move it along as quickly as we can; however, evolving medical treatment and other factors sometimes contribute to delays that we try to anticipate and avoid. Sometimes a new client comes to us with an appeal which is due soon, sometimes even the next day! We have successfully dealt with this problem in the past although, if we cannot get an actual appeal out ,we can send what we call a “place holder” appeal to be supplemented.
