At Herbert M. Hill, P.A., we hear it all the time. The insurance company is harassing you and making it impossible to meet the requirements of making a claim for Short or Long Term Disability benefits. This happens with such frequency, that we feel confident in saying that most of the insurance carriers we regularly work with while representing our clients in their Short and Long Term Disability denials participate in conscious strategy to wear out claimants in an effort to make their claim go away or cause them to be ineligible for benefits by failing to meet a requirement.

This can be done in a multitude of ways. Your assigned claims representative may call you without scheduling to discuss particular points of your condition or job, etc. which you have not been given sufficient time for which to prepare. Of course, in these conversations, anything you may say can and will certainly be used against you, if possible. 

The insurance company will also, through its representatives, reach out to your doctors and other treating professionals for input as to your condition, which is the prudent thing to do. However, the manner in which some of the insurance carriers choose to do this is the problem. They may call your treating physician without notice or scheduling and most physicians are not readily available to take a phone call during the work day. 

Another tactic frequently employed by the insurance company is to make arbitrary deadlines for update paperwork which are much too soon from the time of the receipt of the request for documentation. Claims representative will also claim over and over that they have not received the paperwork you or your doctor faxed or mailed in. Our office does not receive reports that documentation is lost almost at all and nowhere near the frequency we hear from claimants who are not represented.   

None of these tactics are tolerated by our office. However, most unrepresented claimants do not know what the insurance company is allowed or not allowed to do and endure the hardships presented by these maneuvers until they can no longer do so.
